    For me it is really a freak accident.
    Of course nobody wants this, like me, I drive an A/T sedan
    and there was an instance na from parking, magre-reverse ako
    and nakatingin na ko sa likod then naapakan ko pala is GAS!
    I'm supposed to be pressing on brakes kasi nga Automatic buti
    na lang naapakan ko agad un brakes dahil kung hindi tumama na dun
    sa Vios!

    Another is pauwi na ko then sa driveway dumaan yung Truck ng Basura
    eh ayoko na lumipat ng daan kasi nga mapapalayo ako so gumilid na lang ako to wait for it to pass, inayos ko un parking ko. Then when it passed, i forgot naka-Reverse pa pala! i thought it was on Drive pa! Muntik na naman
    sa likod! What a relief!

    This all happened when I was from Graveyard shift. Kaya minsan I think
    talagang humihina ang senses ng mga nagwo-work sa gabi.

    So guys before we step on the car we drive, presence of mind!
    Para iwas hassle and accidents!

    Sana all A/T cars have an audible warning alarm everytime naka-reverse. Mga newer Toyota meron pero mga Honda wala ata.

    i think isa ring tulong ng back up sensor ito. luckily my MS has back up sensor na so once i put the gear shift to R may "single toot" agad na maririnig. may certain number of "toot" combination depende sa pinakamalapit na pwede mabunggo.

    death comes to everybody,anytime and in anyway...

    just look at the forest floor after the storm,you will see leaves scattered around,most are the old withered leaves,some are green,some are still fresh while some are merely shoots...

    may the little boy find peace and a good rebirth. and may the woman find her peace as well and not be too guilty.

    may everybody involved and not involved including us learn from this experience.

    birth,old age,sickness and death...we all experience this. this is the fact of our biological life.

    may all sentient beings,seen and unseen be happy!

    im with you on this one, this is IMO an accident, im surprised that a lot of people woudl burn Ms. Torres to the stake (understandably kung ikaw family ni amiel, i probably would too if it happened to me)..its higly improbable though that Ms. Torres has intent in killing amiel (as what pepes lawyers are sugegesting) and personally trying to prove that is next to impossible. They are both victims here, the later family more than the the former of course. Its also better that this case be judged by the courts who i think would be unbiased and base the penalty of the driver ms. torres on what is due to her as far as the rule of law is concerned.

    I know pepe alcantara, although not personally, used to work in a company where hes an executive. He is a good guy, talks to the rank and file approachable etc..fate has dealt him a cruel blow and he doesnt deserve it, come to think of it nobody does.

    I can only pray that fate will heal pepe and ms. torres wounds..

    i think it is clear above that before an accident is considered as to exempt a person of criminal liability, there should be an absence of negligence. negligence implies that there is no intent.

    so the question is whether the driver was criminally negligent at the time of the incident. if she was negligent at the time then it is not really an accident.. legally speaking. she may be liable for tort (as mentioned earlier) or a felony.

    The imposable penalty, under Art. 365 (2) of the Revised Penal Code, homicide resulting from reckless imprudence in the use of motor vehicle is prision correccional in its medium and maximum periods, which ranges from two (2) years, four (4) months and one (1) day to six (6) years. Under Article 65 of the Revised Penal Code, the penalty shall be divided into three equal portions of time, each of which shall form one period. There being no aggravating or mitigating circumstance, the proper penalty shall be within the medium period, which is three (3) years, six (6) months and twenty-one (21) days to four (4) years, nine (9) months and ten (10) days. Applying the provisions of the Indeterminate Sentence Law, accused is entitled to a minimum term to be taken from the penalty next lower in degree, which is arresto mayor, maximum to prision correccional, minimum. Accordingly, accused should be sentenced to an indeterminate penalty of four (4) months and one (1) day of arresto mayor, as minimum, to four (4) years and two (2) months of prision correccional, as maximum.

    So, mga 4 months to 4 years ang kaparusahan ni Ms. Torres kung macoconvict. Kaya naman gusto ng mga magulang ng biktima maging intentional tulad ng murder. Possible prosecution theory is that while there was first an accident due to the manifested negligence of Ms. Torres, she (similar to the thinking of bus drivers that accident victims are cheaper dead than alive) thought of avoiding the more expensive consequence and stepped harder on the accelarator to ascertain the death of the victim. And for this reason there was evident premeditation qualifying the homicide to murder.

    Medyo long shot, but if the fiscal buys it, she will not only face a longer prison term but could be detained right away and held indefinitely without bail.

    If this happens, the more miserable victims will be the minor children of Ms. Torres who would live a life of hell.

    On the other hand, if Amiel is in heaven, as we believe he is, then he is now enjoying the presence of his Maker where the streets are gold and there are no sadness nor pain. And he won't have to suffer the injustice and corruption of this world.

    In a way, we can envy him and pity the Torres kids.
