    A pleasant day to all forumers!

    Sir I am a new owner of Toyota Vios and my problem is my windshield has been cracked. It is not an accident by the way. My 3 year old son played inside my car (I forgot to lock it) while I am cleaning the hood, then bigla na lang po ako may narinig na cracking sound! When I saw him hawak hawak na nya yung rearview mirror, in other words, naglambitin pala sya dun! buti di sya nasugatan but my problem is, would the Insurance company will pay the replacement in full? almost 3 feet po kasi crack from the origin. Pano po gagawin ko?

    Kung puwede sa insurance (malamang puwede), mayroon ka pa rin participation fee. Depende sa insurance plan ang participation fee.

    Technically, there is a bit of an issue there.. Own damage covers accident caused by third parties or unknown parties only. Not from the Insured themselves or anyone related to the Insured.. The logic is simple to understand. Once we allow own damage to units caused by the Insured or parties related to the Insured, what would stop them from inflicting damage to their own units so as to change the parts? Hope the issue is clear. So you could be in a bit of a grey area there.

    yes pwede mong i-claim sa insurance yan, ma-aksidente ka o ikaw ang maaksidente basta comprehensive insurance mo ok yan i-claim...hindi babayadan ng insurance ng full yan kasi meron kang babayadan na participation fee.

    Sorry, not an expert on these but I have to ask: If what you say is true, then why is it termed "Own"-damage?

    At one point of owning my car, the front wheel fell into an open drainage hole along V. Mapa, necessitating the replacement of major suspension parts, including the whole tire, costing close to 60k. Although, there were no third-parties involved, I was still able to claim it, own-damage. All that was required was a notarized statement of what happened and some other documents... none of which are hard to produce.

    di ko ma gets yun ah... example sumabit ka sa gate nyo di pwede as "own damage"? kung hindi, asan ang OWN dun kung kailangan may THIRD PARTY involved? labo nun.

    Yes, those documents are very easy to produce. Your accident happened while you are using the vehicle. Then its definitely covered. My premise was based on the car while it is parked.

    Again, this is while youre using the vehicle.

    The burden of proof will always be on the insured. You have to prove that the damage was caused by an accident or by some unknown third parties. If it's caused by you or your relatives while the car is parked inside your house, then it COULD be a cause for denial. Not outright denial. But you have to prove that it is an accident. Thats why they require you to submit a notarized affidavit and/or police report.

    Laws are laws. We hate them, but thats what keeps the world orderly.

    The vehicle is covered while in use if driven by someone who is legally allowed to do, that is he should be licensed, not drunk, authorized by the owner, etc. It will be voided if it is used for unlawful purposes or acts that is prohibited.

    It is "own" damage coz it is any damage to your car caused by any acts that are covered. Not all accidents are covered. Like if you dont have Acts of god coverage, then even if you have "own damage", then your car is not covered under the Own damage provisions.

    If you have your policy with you, check Section 3 (Loss or damage)

    Also check "Exceptions to Section 3", item 4.

    FYI lang. So that misunderstanding can be avoided. And as with most laws, there are ways of going around certain provisions, but thats another story..
