Good day mga sir. I bought a 2012 hyundai accent the other day and upon checking the documents, 2014 yung date nung or/CR. Called the previous owner sabi niya na, nakalimutan daw lagyan ng encumbered ng bank yung papeles nung Oto, nalaman na lang nila nung nabatak na yung Oto so dali dali pinabago ng banko. Is it possible na makalimutan ng bank magpalagay ng encumbered sa papers?

Typo error is not uncommon in OR or in CR itself. Once a car is financed by a bank, the first CR issued has no "encumbered" annotated on it. The bank registers the CR with thw Register of Deeds and the LTO and the latter issues a new CR with annotation of encumbrance in favor of the bank. In some cases due to the delay in issuance or delivery by the dealer of the CR to the bank, the latter fails to register the Chattel Mortgage thus leaving the CR without the encumbrance.
Could also be due to the high demand that the manufacturer prioritized new car deliveries vs. spare...
