by the way...

there is no min & max speed limit sign posted in the open-system portion of the NLEX (Balintawak to Bocaue)

the only portion where a max speed sign is posted is when entering exit tollways (which is 40kph) and when merging to the 4-lane highway from the tollbooth (80kph).

which makes our little argument moot & academic. hehe.

ayos lang ang 100kph, for me ha?...
naka survive nga ako sa 80kph from manila to pampanga e.

pag nagbright or bumisina ka galit pa sayo.

well... maybe its just me, or it's just a maybe.

the 55 mph (in the US) and 85 kph (here) general speed limit here was brought about by the oil crisis in the 1970s. with the spiraling cost of oil at the time, our legislators (then Batansang Pambansa) enacted BP No. 73 "AN ACT TO FURTHER PROMOTE ENERGY CONSERVATION AND FOR OTHER PURPOSES". Section 9 of which reads (pertinent phrase in bold) :
Quote Originally Posted by Batas Pambansa Blg. 73

The Ministry of Transportation and Communication is hereby empowered to regulate the use of motor vehicles so as to conserve fuel and relieve traffic congestion, including but not limited to restricting the use of certain type of vehicles during peak hours of the day and during Sundays and legal holidays, or their use for certain destinations or over certain streets during stated hours; or imposing or over careless days; or requiring the organization of car pools in specific areas or among residents of certain neighborhoods; or fixing a minimum number of passengers for certain types of motor vehicles with certain destinations; or fixing speed limits on certain highways or streets; or requiring certificates of roadworthiness before registration of motor vehicles; or denying registration to vehicles which do not meet the standards of energy consumption set pursuant to the provisions of this Act; or setting and enforcing yearly limits on the number of passenger car that are sold and/or registered for the first time.
The MoT, at the time, simply copied over the US system converted to kph and rounded off the the nearest 5 which gives us our 85 kph national speed limit.

I think that this section of the law has not been repealed (we need another law to specifically state the repeal) and law enforcers can still use this against us if they were smart enough.

It's interesting that the section on banning of importation of large displacement and high weight vehicles was repealed specifically by Cory Aquino during her time but not the rest of it.

Of course, this also means that only the MoT (or, now, DoTC) can specify speed limits. This leads to the question as to the validity of the speed limits on the highways set by the PNCC and MNTC. I once used this argument when I was stopped for overspeeding in SLEX. I showed the booth person my copy of BP 73 and asked them to produce a copy of a law (be it RA, BP, EO or whatever that shows that they have authority to do so.) with a follow up statement that if they hold me further without cause they can be liable under law. So far, reaction has been a bit of head scratching and them letting me go.

Kung gusto nyo subukan POWER ng auto nyo at GALING nyo sa driving, NLEX and SLEX is not the right place, do it at the race track. Dami inusente madadamay lalo na mga kids , usually sleeping during the journey.

Ok lang sa akin ang 100KPH max as long as:

1.) Buses and trucks are all in 1 lane lang.
2.) Motorcycles are all in 1 lange lang.
4.) Enforced din ang minimum speed limit.

just my two cents

Takot!, lahat sumusunod.
