    A decision is a decision. You can file an appeal to reverse an earlier decision, though... But I don't know if you can reverse an SC ruling... Except if you're PAL and the CJ is Corona, that is...

    ^ The CJ can't reopen decided cases. It's called res judicata.

    Unless it's still open? I think close issue na yung ibalik sa magsasaka.. ang naka pending pa due to MR (if I remember it correctly) is yung compensation na tatanggapin ng Cojuangco ... either valuation at 1989 prices or at 2006 ba yun if I'm not mistaken..

    1989 ata yung dapat nai turnover na sa magsasaka yun..

    2006 yung kung kailan naging final <?> yung decision or was it kung kailan nilabas yung decision revoking the SDO (if I remember it correctly yung time ni GMA at ang DAR Secretary then was si Pangandaman yata)...


    so kung bukas pa issue ng compensation.. and Sereno had the opinion na dapat 2006 valuation... yan... maganda pag debatehan...

    Haven't heard if HLI or the Cojuangcos actually appealed that part of the decision (re: just compensation and valuation). If they did, then it is only an collateral issue while the main argument, that is, whether or not the land should be distributed to the farmers, has already been decided. AFAIK, there is good reason (including numerous decided cases) to argue that the taking or transfer of property should always be based on fair market value at the time of taking.
